Can a Medical Marijuana Dispensary Operate in Dublin, CA?

The short answer to that question is “No.” With recent news about dispensaries being closed throughout California and the statewide proposition, officially called the Regulate, Control and Tax Cannabis Act of 2010, to legalize marijuana in California on the November ballot, some readers may be curious about where the City of Dublin, CA, stands on medical marijuana dispensaries. A medical marijuana dispensary is any facility or location, whether fixed or mobile, where medical marijuana is made available to, distributed by, or distributed to two (2) or more qualified patients, persons with valid identification cards, or primary caregivers.

At its August 16, 2005, meeting, the Dublin City Council adopted a forty-five day moratorium on medical marijuana dispensaries within the city limits. On September 20, 2005, the Council extended the moratorium for a period of 10 months and 15 days to allow the City to evaluate medical marijuana dispensaries. At that same meeting, the City Council requested to have Dublin’s City Attorney research dispensaries and bring the matter to Council for discussion. Dublin’s City Council passed ordinance 19-09 on May 2, 2006, banning the operation of a medical marijuana facility (Municipal Code 5.58.020).

Proponents of the use of marijuana for medicinal purposes argue that marijuana can relieve certain types of pain, nausea, vomiting, and other symptoms caused by certain types of illnesses. Opponents counter that insufficient research data exist to support such assertion. Further, many believe that marijuana can have adverse effects on health and is a gateway drug that can lead to the use of more dangerous controlled substances.

Californians passed Proposition 215 back in 1996 to allow for the use of medical marijuana. Many experts believe that the 2010 proposition to legalize marijuana in California could create a backlash against medical marijuana dispensaries. While the Regulate, Control and Tax Cannabis Act of 2010 may not get voter approval this November, the debate over the medical use of marijuana is likely to continue in cities throughout the state of California.

    It’s time to let ordinary Americans grow a little marijuana in their own back yards.
    Hopefully Californians will be prepared for the “October Surprise” that the prohibitionists will pull out of the hat as November approaches. They will no doubt try some late-breaking scare tactics and continue to ignore the harm caused by putting our young people in prison, the loss of tax revenue, the waste of tax money, the huge cost of enforcement, and all of the other evils of prohibition.
    Parents, let’s watch out for the “October Surprise” and let’s stop putting our own kids in jail!

    I was totally going to sign that petition but then I got hungry and had to eat some FUNYUNS and a Mello Yellow. What we need to realize is we left this England place ’cause it was bogus; so if we don’t get some cool rules ourselves – pronto – we’ll just be bogus too! Get it?

    All I need are some tasty waves, a cool buds, and I’m fine.

    What in the world prompted this article? I haven’t heard of any discussion of bring pot clubs or dispensaries to the Tri-Valley — so I’m not sure why this topic is being reported. What’s next:
    1) Can a coal-fired power plant be built in Dublin?
    2) Can Camp Parks be used to dispose of spend nuclear fuel rods?
    3) Can California’s proposed high-speed rail system be routed down Dublin Blvd?

    Of course I’m saying this tongue-in-cheek — but my point is let’s stick to articles that are relevant and wont put the thought in people’s heads that this is even under discussion for Dublin.

      “Can Camp Parks be used to dispose of spend nuclear fuel rods?”

      What?!!!! what does this have to do with medical marijuana? And why shouldn’t it be under discussion? I’d be more worried about the alcohol so many kids are drinking illegally than marijuana.
